Scope of application

  • Neonatal cerebral palsy caused by the delivery process or cerebral palsy of the newborn caused by abnormalities related to parturition after delivery
  • Mother's death caused by the delivery process or mother's death caused by abnormalities related to parturition after delivery
  • Fetal death caused by the delivery process or death of the newborn caused by abnormalities related to parturition after delivery

Application criteria

Applicable only to delivery medical accidents since April 8, 2013

Claim date

Claim within 14 days from the date of receiving notice from the director of the medical conflict adjustment committee that compensation can be requested to the compensation deliberation committee

Claim method

  • Visit application of medical accident compensation deliberation committee (proxy payment examination team)
  • Application by internet homepage and mail

Requester's requisition

  • Victim or agent of medical accident
  • Agent's requisition: a legal representative of the victim, a spouse, a lineal ascendant or descendant, a lawyer, etc.
